  • Types of outlets that sell the product
  • The type of consumers they cater to and the expectations of the consumer. This includes customer needs that the retail outlet is fulfilling, the factors influencing the consumers to choose a particular outlet, and the extent to which they patronize the outlets.
  • The behavior of the retailer with respect to displays, inventory, etc.

These profiles will help the marketer identify the type of outlets that would be catering to the target segment identified in the marketing strategy or the outlets that would suit their positioning strategy.

Res Judicata


The old Latin legal phrase, res judicata, means a thing already decided and settled. Res judicata is a legal principle quite consistently followed by almost all courts. It is the rule that a final judgment or decree on the merits of a matter by a court of competent jurisdiction will be final and conclusive as to any later lawsuit on all points or matters determined in the former suit. This means that between the parties themselves the dispute is closed at the conclusion of trial. However, this does not prevent a lower court decision from being appealed to a higher court.

This principle of res judicata prevents  an unsuccessful litigant from taking an unfavorable decision to another trial court for a second lawsuit on the same complaint or same set of facts. Res judicata applies between the parties in a civil lawsuit, affecting those parties and no others.

Elaborative Creativity


Elaborative creativity is the innovative amplification of a core idea or principle. The difference is between say, staff empowerment as a core belief and its amplification into personnel policies, participative management structures, training programs, and so forth. Elaboration can become innovative when it is creatively contextualized, that is, creatively fitted to the organization’s situation rather than simply borrowed from elsewhere. It can become innovative when it is done participatively, involving various viewpoints and much brainstorming, and the ideas are creatively synthesized. It can become innovative when not just one but several powerful, possibly partially conflicting ideas are fused together to form its basis, such as the ideas of centralization and decentralization, control and authority, or internal entrepreneurship and efficiency. Elaboration can also become innovative when it is periodically reviewed and creatively modified to suit changing circumstances. And it can become innovative when it is benchmarked, not with practices of the leading competitor, but the world’s best practitioners. And not necessarily in the organization’s industry, but in any sector of activity, for then it may reveal gaps that can be bridged only innovatively. When elaboration is made innovative in these ways, it is difficult for others to copy it, and therefore such elaboration confers a competitive advantage on the organization.

The Creative Selling Process


Although it may look easy, creative selling is not a simple task. Of course, some sales are made in a matter of minutes. But others, particularly for large organizational purchase, can take years to complete. Salespeople should follow a carefully planned process from start to finish.

Step 1: Prospecting: Prospecting is the process of finding and qualifying potential customers. This involves three activities:

  • Generating sales leads. Sales leads are names of individuals and organizations that might be likely prospects for the company’s products.
  • Identifying prospects. A prospect is a potential customer who indicates a need or a desire for the seller’s product.
  • Qualifying prospects. Not all prospects are worth investing sales time in. some may not have the authority to buy, and others won’t have enough money. The ones who do have both the authority and the available money are called qualified prospects.

Step 2: Preparing: With a list of hot prospects in hand, the salesperson’s next step is to prepare for the sales call. Without this preparation, the chances of success are greatly reduced. Preparation starts with creating a prospect profile, which includes the names of key people, their role in the decision-making process, and other relevant information such as the prospect’s buying needs, motive for buying, current suppliers, income/revenue level, and so on.

Next, the salesperson decides how to approach the prospect. Possible options for a first contact include sending a letter or cold calling in person or by telephone. For an existing customer, the salesperson can either drop by unannounced or call ahead for an appointment, which is generally preferred.

Before meeting with the prospect, the salesperson establishes specific objectives to achieve during the sales call. Depending on the situation, objectives can range anywhere from “getting the order today” to simply “convincing prospects top accept the company as a potential supplier.” Following that, the salesperson prepares the actual presentation, which can be as basic as a list of points to discuss or as elaborate as a product demonstration or multimedia presentation.

Step 3: Approaching the Prospect: Positive first impressions result from three elements. The first is an appropriate appearance—you wouldn’t wear blue jeans to call on a banker, and you probably wouldn’t wear a business suit to call on a farmer. Appearance also covers the things that represent you, including business cards, letters, and automobiles. Second, a salesperson’s attitude and behavior can make or break a sale. A salesperson should come across as professional, courteous, and considerate. Third, a salesperson’s opening lines should include a brief greeting and introduction, followed by a few carefully chosen words that get the prospect’s attention and generate interest. The best way to accomplish this is to focus on a benefit to the customer rather than on the product itself.

Step 4: Making the Presentation: the most critical step in the selling process is the presentation. It can take many forms, but its purpose never varies: to personally communicate a product message that will convince a prospect to buy. Most sellers use of two methods: The canned approach is a memorized presentation (easier for inexperienced sellers, but inefficient for complex products or for sellers who don’t know customer’s needs). The need satisfaction approach (now used by most professionals) identifies the customer’s needs and creates a presentation to specifically address them.

Step 5: Handling Objections: No matter how well a presentation is delivered, it doesn’t always conclude with an immediate offer that might move the prospect to buy. Often, the prospect will express various types of objections and concerns throughout the presentation. In fact, the absence of objections is often an indication that the prospect is not very interested in what the salesperson is selling. Many successful salespeople look at objections as a sign of the prospect’s interest and as an opportunity to develop new ideas that will strengthen future presentations.

Three basic approaches to overcoming objections include asking the prospect a question, giving a response to the objection, or telling the prospect that you will need to look into the matter and address it later.

Step 6: Closing: So far, you haven’t made a dime. You may have spent weeks or months—years in some cases—to bring the customer to this point, but you don’t make any money until the prospect decides to buy. This stage of the selling process, when you persuade the customer to place an order, is referred to as closing.

How should you ask for the order? Closing techniques are numerous; here are some of the more popular. The alternative proposal close asks the prospect to assumptive close, you simply proceed with processing the order, assuming that the prospect has already decided to buy. Another alternative is the silent close, in which you finish your presentation and sit quietly, waiting for the customer to respond with his or her buying decision. Finally, many salespeople prefer the direct close, where you just come right out and ask for the order.

These closing techniques might strike you as tricks, and in the hands of unethical salespeople, some closing approaches certainly can be. But the professional salesperson uses these techniques to make the selling process effective and efficient—not to trick people into buying when they aren’t ready.

Step 7: Following Up: Most salespeople depend on repeat sales, so it is important that they follow up on all sales and not ignore the customer once the first sale is made. During this follow-up stage of the selling process, you need to make sure that the product has been delivered properly and that the customer is satisfied. Inexperienced salespeople may avoid the follow-up stage because they fear facing an unhappy customer. However, an important part of a salesperson’s job is to ensure customer satisfaction and to build goodwill.

In order to improve the odds of keeping a satisfied customer after the sale, salespeople should remember to:

  • Handle complaints promptly and pleasantly
  • Maintain contact with customers
  • Keep serving the customers
  • Show appreciation.

Implementing the Sales Program


As with any kind of management, implementing a sales program involves motivating and directing the behavior of other people—the members of the sales force. To be effective, the sales manager must understand why the people in his or her sales force behave the way they do. Then policies and procedures can be designed to direct their behavior toward the desired objectives.

The model of the activities involved in implementing a sales program suggests that five factors influence a sales rep’s job behavior and performance:

  1. Environmental variables: Regardless of how highly motivated or competent salespeople are, their ability to achieve a particular level of job performance is influenced—and sometimes constrained—by environmental factors. The ability to reach a given sales volume, for instance, can be affected by such things as the market demand for the product being sold, the number and aggressiveness of competitors, and the health of the economy. Similarly other elements of a firm’s marketing mix, such as the quality of its products and the effectiveness of its advertising, can affect a salesperson’s ability to reach a high level of sales performance.
  2. Role perceptions: To perform adequately, a salesperson must understand what the job entails and how it is supposed to be performed. The activities and behaviors associated with a particular job are defined largely by the expectations and demands of other people, both inside and outside the organization. Thus, a salesperson’s job (or role) is defined by the expectations and desires of the customers, sales manager, other company executives, and family members. The salesperson’s ability to do the job well is partly determined by how clearly the sales rep understands those role expectations. Also, the salesperson may sometimes face conflicting demands, as when customer wants a lower price but company management refuses to negotiate. The salesperson’s ability to resolve such conflicts helps determine success or failure on the job.
  3. Aptitude: A salesperson’s ability to perform the activities of the job is also influenced by the individual’s personal characteristics, such as personality traits, intelligence, and analytical ability. No matter how hard they try, some people are never successful at selling because they do not have the aptitude for the job. Of course, different kinds of sales jobs involve different tasks and activities, so a person with certain characteristics may be unsuited for one selling job but tremendously successful at another one.
  4. Skill levels: Evan when salespeople have the aptitude to do their jobs and an understanding of what they are expected to do, they must have the skills necessary to carry out the required tasks.
  5. Motivation level: A salesperson cannot achieve a high level of job performance unless motivated to expend the necessary effort. A person’s motivation is determined by the kind of rewards expected for achieving a given level of performance and by the perceived attractiveness of those anticipated rewards.

A sales manager can use several policies and procedures to influence the aptitude, skill levels, role perceptions, and motivation of the sales force. Implementing a sales program involves designing those policies and procedures so that the job behavior and performance of each salesperson are shaped and directed toward the specified objectives and performance levels.

Realigning the Organization


Organization or reorganization schemes have been proposed ad nauseam as solutions to many business problems. As a general rule, organizational changes, especially those that simply reshuffle the same names into different boxes on the organization chart, don’t improve anything. This does not mean suggesting some new organization approach that is better suited for these turbulent times. However, many organizations are too top-heavy, over-structured, and over-satisfied to be responsive to market needs and too costly to be competitive. The structure and staffing of any organization must be rigorously challenged to ensure it is really geared to accomplish the fundamental objectives of the business in as cost-effective a manner as possible. An honest evaluation of the answers to the following critical questions will provide a good function for action.

a)        Is the organization structured to serve markets or simply to manage functions and sell products? Have priority markets been identified? Does someone have primary responsibility for ensuring that the product/service package is tailored to each target market? Do mechanisms exist to ensure cross-markets? Is there any kind of a market focus in the selling organization?

b)        Are there enough discrete profit centers? Do enough managers feel the burden of full profit responsibility? Is the business unit larger than its most successful smaller competitors? Are there any big cost centers that are not assigned or allocated to someone who has a profit and loss responsibility?

c)        Are there corporate group or division staff redundancies? Do the same titles exist at different levels (e.g., corporate controller, group controller, division controller, plant controller)? If so, does it make sense? Can staff position or groups show how they actively contribute to profit results? If so, do line managers agree that these functions are worth the cost?

d)        Are there too many layers? Are there more than five layers between the business unit manager and first level workers? Are there managers with assignments limited to managing one, two, three or four people? Why? Can any of these activities be combined under one manager? Why not?

e)        Is the ratio of supporters to actual results producers satisfactory? How many people actually make a direct contribution to results (e.g., first-line sales personnel, direct hourly workers, sales order engineering and order entry workers, handlers of incoming materials, and storing and shipping personnel)? How many managers, staff, and support personnel are cheering them on? If there is more than one support person for every two producers, what do they do? How do they contribute to profits?

The questions are not new, but the answers are more important now than ever. Traditional or experience-based answers are probably wrong because conditions have changed so dramatically. Moreover, it is doubtful whether existing management can or will ever come up with the right answers, because they have vested interests and the changes needed are simply too tough for them to swallow. These organization structure questions are not as serious for many small to medium-size companies since they are not as likely to be troubled with highly structured, functionally focused organizations lacking a dedicated market orientation. However, even managers in these companies must constantly fight the natural tendency to become more structured, bureaucratic, and lethargic.
